Terms of Service
The operator of Whimo (“we”, “us”, or the “Operator”) establishes these Terms of Service (these “Terms”) for the use of the mobile application “Whimo” (formerly “Dokoiko”) (the “App”). Please read these Terms carefully before using the App.

These Terms are prepared in Japanese and translated into English. In the event of any inconsistency between the two versions, the Japanese version shall prevail to the extent permitted by applicable law.
Article 1 (Application)
- These Terms apply to all aspects of your use of the App.
- By using the App, you are deemed to have agreed to these Terms.
Article 2 (Registration)
- To use the App, you must sign up with an email address, a Google account, an Apple account, or an anonymous account.
- You are responsible for managing your sign-up information.
- If we find that a registration was made with false information or for a purpose that violates these Terms, we may refuse or revoke the registration.
Article 3 (Services Provided)
The App allows you to record places you want to visit and places you have visited, and to create groups to share them with other users. The details and specifications of the features provided are subject to change without notice.
Article 4 (Fees and Paid Subscriptions)

The basic features of the App are free to use.

The App offers a paid plan, “Premium” (the “Paid Plan”), as an auto-renewable subscription that unlocks additional features. The Paid Plan is available as a monthly plan or an annual plan.

Price: The price of the Paid Plan is the amount displayed on the App Store purchase screen at the time of purchase (inclusive of applicable taxes). Prices vary by country or region and are subject to change.

Payment: Payment will be charged to your Apple ID account upon confirmation of purchase. Purchases, billing, and refunds for the Paid Plan are handled by Apple (App Store), and we do not receive your credit card or other payment details.

Auto-renewal: The Paid Plan renews automatically. Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription renews automatically and the fee for the next period is charged within 24 hours before the end of the current period.

Cancellation and management: You can turn off auto-renewal (cancel) and view or change your subscription at any time in the iOS Settings app → (your name) → “Subscriptions”. Cancellation must be made before the next renewal date; after cancellation, you can continue to use the Paid Plan until the end of the period you have already paid for. No pro-rated refunds are provided for cancellation partway through a period.

Restoring purchases: If you reinstall the App (for example, after changing devices), you can restore a Paid Plan purchased with the same Apple ID using the “Restore Purchases” feature in the App.

Refunds: Refunds after purchase are subject to Apple’s policies and procedures. We cannot provide individual refunds.

The scope and content of features available under the Paid Plan are subject to change without notice for service improvement.
Article 5 (Prohibited Conduct)
When using the App, you must not:
- Violate laws or public order and morals
- Engage in conduct related to criminal activity
- Infringe the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Operator, other users, or third parties
- Place excessive load on the App’s network or systems
- Analyze the source code by reverse engineering, decompiling, disassembling, or similar means
- Gain or attempt to gain unauthorized access
- Impersonate another user
- Use the App for commercial purposes without our permission
- Provide benefits, directly or indirectly, to antisocial forces
- Engage in any other conduct that we deem inappropriate
Article 6 (User Content)
- The rights to spot information, notes, lists, group information, and other content you register in the App (“User Content”) belong to you.
- You grant us permission to store, reproduce, and display User Content to the extent necessary to provide, operate, and improve the App.
- You warrant that your User Content does not infringe the rights of any third party.
- If you share User Content with other members using the group feature, that content becomes visible to the members of the group.
Article 7 (Suspension of the App)
We may suspend or interrupt all or part of the App without prior notice to you if we determine that any of the following applies:
- Maintenance, inspection, or updating of the systems for the App
- Force majeure such as earthquake, lightning, fire, power outage, or other natural disasters makes it difficult to provide the App
- Computers or communication lines stop due to an accident
- We otherwise determine that providing the App is difficult
Article 8 (Restriction of Use and Revocation of Registration)
If you violate any provision of these Terms, we may restrict your use of the App or revoke your registration as a user without prior notice.
Article 9 (Withdrawal and Account Deletion)
You may delete your account and related data at any time using the “Delete Account” feature in the App. Deleted data cannot be restored.
Article 10 (Disclaimer of Warranties and Limitation of Liability)
- We make no warranty, express or implied, that the App is free from defects of fact or law (including defects, errors, and bugs relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security, and rights infringements).
- To the maximum extent permitted by applicable law, we are not liable for any damage you incur arising from the App, except in cases of our willful misconduct or gross negligence.
- We are not responsible for any transactions, communications, or disputes between you and other users or third parties.
- Spot and map information displayed in the App is obtained from third-party services such as the Google Maps API and Google Places API, and we do not guarantee its accuracy or currency.
- Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees that cannot be excluded, restricted, or modified under applicable law, including the Australian Consumer Law, the UK Consumer Rights Act 2015, and other mandatory consumer protection laws of your place of residence.
Article 11 (Changes to the Service)
We may change the content of the App or discontinue providing the App without prior notice to you, and, to the maximum extent permitted by applicable law, we are not liable for any damage you incur as a result.
Article 12 (Changes to These Terms)
We may amend these Terms at any time when we deem it necessary, without notice to you, to the extent permitted by applicable law. If you continue to use the App after an amendment to these Terms, you are deemed to have agreed to the amended Terms.
Article 13 (Personal Information)
Personal information obtained through your use of the App is handled appropriately in accordance with our separately established Privacy Policy.
Article 14 (Notices and Communications)
Notices and communications between you and us will be made by methods we designate (in-app notices, email, etc.).
Article 15 (No Assignment of Rights and Obligations)
You may not assign your position under the usage agreement or your rights or obligations under these Terms to a third party, or provide them as security, without our prior written consent.
Article 16 (Governing Law and Jurisdiction)
- These Terms are governed by the laws of Japan.
- Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Operator.
- Notwithstanding the foregoing, if you are a consumer, you may benefit from any mandatory provisions of the law of the country or state in which you reside, and nothing in this Article deprives you of the protection of such provisions or of any right you may have under applicable law to bring proceedings in the courts of your place of residence.
Article 17 (Language)
These Terms are prepared in Japanese and translated into English for reference. In the event of any inconsistency or discrepancy between the Japanese version and the English version, the Japanese version shall prevail to the extent permitted by applicable law.
